Colorado has tough laws and sentencing guidelines for people who are convicted of driving under the influence (DUI) or driving while ability impaired (DWAI). You could be charged with impaired driving for being under the influence of alcohol, drugs or both.

Charges for impaired driving include:

  • Driving under the influence (DUI) – A person can be charged with DUI for driving under the influence of alcohol, drugs, or a combination of both.

  • Driving while ability impaired (DWAI) – Ability impaired is presumed when the BAC is above .05% but less than .08%.

  • DUI per se – A person with a BAC of .08% or higher can be charged for driving under the influence of alcohol.

In Colorado, you could be charged with DUI, even if the vehicle isn’t moving. The law applies to anyone who is in physical control of the vehicle, so you could be accused of DUI or DWAI for sitting in your car while under the influence.

Penalties for Conviction

The penalties for a DUI conviction in Colorado are strict, even for a first offense. The loss of your driver’s license makes getting to work, school, and necessary appointments extremely difficult.   • Third offense – A jail sentence of 60 days to one year, fines of $600 to $1,500, indefinite license, and an ignition interlock device for two to five years

In addition to criminal penalties and loss of your driver’s license, individuals convicted of DUI, DWAI, or DUI per se are required to complete an alcohol and drug evaluation and recommended treatment and pay all fees for the evaluation and treatment. A second or subsequent conviction will result in two years of probation and completion of an education and treatment program.
